A U.S. District Judge, Fernando Rodriguez Jr., has permanently prohibited the Trump administration from using the 1798 Alien Enemies Act to deport Venezuelan migrants in South Texas, ruling that the March proclamation āexceeds the scopeā of a wartime statute and is therefore āunlawfulā.
In his 36-page opinion, Rodriguez wrote, āThe President cannot summarily declare that a foreign nation or government has threatened or perpetrated an invasion or predatory incursion of the United States,ā because the administration failed to prove an organized armed attack as required by the Act.
Within the past several weeks, at least seven separate lawsuits have been filed challenging Trumpās executive ordersāfrom border-wall contracts to sanctuary-city fundingāarguing that each directive likewise exceeds presidential authority and violates due-process protections. Another suit aims to disqualify senior administration officials by branding them āenemy agents,ā a legal theory that could paralyze key national-security appointments if left unchecked.
In response, the administrationās legal team has initiated counter-litigation, filing declaratory-judgment actions to affirm the legality of its policies and seeking sanctions against plaintiffs whom they describe as engaging in āpolitically motivated lawfare.ā Representative Jim Jordan, leading the congressional defense effort, declared, āWe will defend every order and stand up for the votersā mandate in every courtroomā.
